Welcome to Hearten Company. These Terms and Conditions (“Terms”) govern your access to and use of our website https://www.heartencompany.com (the “Site”) and your purchase of our baked goods, catering services, or related products (“Products”).

By visiting our Site or placing an order, you agree to these Terms. Please read them carefully.

2. Eligibility

You must be at least 18 years of age to purchase from our Site. By using our Site, you represent that you are of legal age and capable of entering into a binding contract.

3. Orders & Payment

  • All orders placed through the Site are subject to acceptance by Hearten Company.

  • We reserve the right to refuse or cancel any order for reasons including product availability, errors in pricing, or suspected fraud.

  • Payment is due in full at the time of order unless otherwise arranged in writing (e.g., approved wholesale or catering accounts).

  • We process payments securely through Square. We do not store credit-card data on our servers.

4. Pricing & Availability

Prices, products, and delivery schedules are subject to change without notice.

All prices are listed in U.S. dollars and include applicable taxes where required.

5. Local Delivery

We currently provide direct local delivery in the following areas:

  • Fresno & Clovis: Thursdays 4:30 – 6:30 PM

  • Madera: Thursdays 5:00 – 7:00 PM

  • Merced: Fridays 7:30 – 11:30 AM

A $5 flat delivery fee applies to Home & Gift orders.

Orders placed after Wednesday at 12:00 PM will be delivered on the next available route.

If no one is available to receive your delivery, Hearten Company is not responsible for product quality after drop-off time.

6. Refunds & Cancellations

Because our products are perishable and made to order:

  • Orders cancelled before production begins (by Wednesday noon) may be eligible for a refund.

  • Orders cancelled after production begins, or missed deliveries, are not refundable.

  • If your order arrives damaged or incorrect, please contact us within 24 hours at info@heartencompany.com with your order details and photos. We will either replace or credit your order at our discretion.

7. Allergen Notice

Our baked goods contain or may come into contact with wheat, dairy, eggs, soy, and tree nuts (including pecans and pistachios). We cannot guarantee an allergen-free kitchen.

8. Intellectual Property

All text, images, designs, logos, recipes, and other content on this Site are the intellectual property of Hearten Company LLC or its licensors.

You may not reproduce, distribute, or modify any materials without prior written permission.

9. User Conduct

You agree not to:

  • Use the Site for any unlawful or fraudulent purpose;

  • Attempt to interfere with or compromise the Site’s security or functionality;

  • Use automated tools (bots, scrapers) to access or copy Site content;

  • Misrepresent your identity or impersonate another person.

10. Limitation of Liability

To the fullest extent permitted by law, Hearten Company LLC is not liable for any indirect, incidental, or consequential damages arising out of your use of this Site or purchase of Products. Our total liability for any claim shall not exceed the amount you paid for the specific order at issue.

All products are sold “as is” and “as available.” We make no warranties, express or implied, regarding fitness for a particular purpose.

11. Indemnification

You agree to indemnify and hold harmless Hearten Company LLC and its employees, owners, and affiliates from any claims or damages arising from your use of the Site or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflicts of law principles. Any dispute shall be brought exclusively in the state or federal courts located in Merced County, California.

13. Changes to These Terms

We may update these Terms at any time. Any changes will be posted with a revised “Last Updated” date. Continued use of our Site or ordering after changes are posted constitutes your acceptance of the new Terms.
